Terms of Service

Effective 2 November 2026

1. Provider and acceptance

Decision Workout (the “Service”) is provided by Pragmatic Five AS, organisation number 938 652 279 (“we”, “us”).

By creating an account, using a licence key, joining a session or completing a purchase, you accept these Terms, the Refund Policy and the Privacy Policy. If you accept on behalf of an organisation, you confirm that you are authorised to bind it.

2. The Service

The Service is a digital training course in non-technical skills. Depending on the plan purchased, it may include video lessons, quizzes, a course exam, self-evaluation, decision games, briefings, feedback sessions, simulation exercises and group administration.

We may modify or discontinue features. If a change materially reduces the Service during a paid access period, you are entitled to a proportionate refund or a corresponding extension.

3. Accounts

You must be at least 16 years old, provide accurate information and keep your login credentials and licence keys confidential. You are responsible for activity under your account and must notify us without undue delay of any unauthorised use.

4. Orders, prices and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

The price, taxes, currency and access period are those stated at checkout. Access is purchased for a fixed period by a one-time payment, does not renew automatically and is activated when payment is confirmed. A separate written agreement with an organisation prevails over these Terms in the event of conflict.

Refunds

Refunds are handled by Paddle in accordance with the Refund Policy. A full refund may be requested within 14 days of purchase, provided that the course exam has not been passed and no more than half of the course lessons have been completed. By requesting immediate access at checkout, you acknowledge that the statutory right of withdrawal is lost.

5. Group licences

A group licence comprises the number of seats stated in the order. Each seat is for one named individual and may not be shared or transferred outside the purchasing organisation. The group owner is responsible for assigning seats and for access to seat users’ progress and results.

6. Guest access

Hosts may invite participants to sessions by code, without an account. The host is responsible for distributing codes and conducting the session. Guests are bound by sections 7 and 8.

7. Acceptable use

You must not: (a) use the Service unlawfully or fraudulently; (b) gain or attempt to gain unauthorised access to the Service or other accounts; (c) introduce malware or interfere with the security or operation of the Service; (d) scrape, copy or extract course material, or use it to develop a competing product; (e) submit content that is unlawful or infringes the rights of others; or (f) misrepresent your identity or qualifications.

8. User content

You retain ownership of content you submit and grant us a non-exclusive, royalty-free licence to host, store and display it solely to provide the Service.

You must not submit sensitive personal data, including health information, national identity numbers or the identity of patients or clients. You are responsible for your content and for complying with any duty of confidentiality. We are not responsible for sensitive personal data that users choose to enter. We may remove content that breaches these Terms.

9. Intellectual property

All rights in the Service belong to Pragmatic Five AS or its licensors. We grant you a limited, non-exclusive and non-transferable right to use the Service during the paid access period for your own training or, under a group licence, for the internal training of the licensed organisation.

10. Educational purpose

The Service is for education only. It does not constitute clinical, operational, legal or other professional advice and does not replace protocols, mandatory training or employer procedures. Simulators are training aids, not medical devices.

A completion record confirms only that the named user has completed the e-learning requirements in the Service. It is not a certification, accreditation or licence to practise. Self-evaluation scores are for learning only.

11. Availability

We do not warrant uninterrupted or error-free operation. Maintenance may temporarily limit access.

12. Suspension and termination

You may delete your account at any time under My account. We may suspend or terminate access with immediate effect in the event of a material breach of these Terms, fraud or a security risk. Unless mandatory law provides otherwise, termination due to your breach does not entitle you to a refund.

13. Liability

We are not liable for indirect or consequential loss, including loss of profit or data, or for decisions taken in real-world settings. Our aggregate liability in any twelve-month period is limited to the amounts paid for the Service in that period. This does not limit liability that cannot be limited under applicable law, including for gross negligence or wilful misconduct, or the mandatory rights of consumers.

14. Changes

We may amend these Terms and will give reasonable advance notice of material changes in the Service or by email.

15. Governing law and disputes

These Terms are governed by Norwegian law, without prejudice to mandatory consumer protection under the law of your country of residence.

Consumers resident in Norway may bring a complaint before the Norwegian Consumer Council (Forbrukerrådet) and the Consumer Complaints Board (Forbrukerklageutvalget).
